Guardrails

AI support must remain subordinate to judicial judgment.

The Judicial AI Standards Institute evaluates tools for court operations, legal-reference workflows, and judicial-support settings. The Standard sets operational boundaries before a tool is represented as appropriate for court use.

Permitted support

Within certified scope

  • Court-facing legal-reference and citation workflows.
  • Organization and summarization of authorized materials.
  • Policy comparison, administrative support, and intake routing.
  • Drafting assistance where a judge or authorized court user remains responsible for review.

Prohibited functions

Outside the Standard

  • Replacing judicial reasoning or independent decision-making.
  • Investigating facts outside the record.
  • Evaluating witness credibility.
  • Recommending case-specific rulings.
  • Supplying extra-record adjudicative facts.

Human control is mandatory.

A tool evaluated under The BenchMark Standard must remain transparent, reviewable, and subject to human override. Certification does not transfer responsibility from the court user to the system.
